PRELIMINARY PAPERWORK

All properties are required to have a “passport” that establishes the legality of the property you are buying and ultimately makes the buying/selling process quicker and easier.

Promissory contract (CPCV)

Official contract, signed by both parts in front of an official Notary, generally accompanied by a deposit payment. It must include the full details of the seller, the purchaser and the property; agreed price, payment conditions and any special terms and conditions of the contract, including completion date.

Property “Passport”

1 - Tax Document

Certifies the inscription of the property for tax purposes, identifies the owner and his fiscal number, and describes the property (number of rooms, area and type of plot, history, etc.) including its unique fiscal number.

2 - Certification by the Building Registration Office

Documento que certifica quem é o proprietário do imóvel e comprova a existência de eventuais ónus/encargos sobre a propriedade.

3 - Usage and Habitation Licences / Licence of use

Certifies that the property is approved for the purposes of the original building permission.

4 - IMI

(Imposto Municipal sobre Imóveis)
Annual council tax, defined by the City Council. It is established according to a set of limits, depending on the type of property with a variation between 0,2 % to 0,8% of the property value. For off shores it may reach 5%.

5 - IMT

(Imposto Municipal sobre Transmissões Onerosas de Imóveis)
Deverá ser pago antes da realização da escritura.
This tax depends on the property type and price and it goes from 0% to 8%

6 - Final Deed

The title of the property is transferred when it is signed by a Public Notary who is responsible for checking and certifying the legal exactness of the entire transaction, ensuring that all documents are in perfect order and any applicable purchase taxes have been paid.

7 - Registering Ownership

Uma vez assinada a escritura, a propriedade deverá ser registada no nome do seu novo proprietário. Este registo é condição de eficácia perante terceiros e impede que outrem registe o imóvel em seu nome.

8 – Land registration at the tax office

This registration allows the establishment of fees and annual taxes, such as IMI.
É obrigatório efectuar no prazo de 60 dias após a compra.

9 - Notary and Registration Fees

The owner is responsible for paying these once the Final Deed, has been signed.

10 - Utilities

Uma vez registada a propriedade, a Garvetur poderá requerer mediante autorização do novo proprietário uma série de serviços, directamente ou através dos seus parceiros como sejam electricidade, água, telefone, rentabilização, manutenção, limpeza, seguro, decoração e gestão de condomínio.
